The Technical Advisory Committee (TAC) includes individuals representing developers, landowners, and consultants active in the area of brownfields assessment, remediation, and redevelopment. TAC monitors proposed legislative and regulatory changes at the municipal, provincial, and federal level that could affect brownfield redevelopment, and responds to requests for public comments advocating for regulations and policies that are founded on sound science and appropriate risk, harmonized across jurisdictions, and provide clarity and certainty with respect to brownfield redevelopment.  Since our last update in June 2020, TAC has undertaken the following on behalf of CBN members:

British Columbia: CBN submission to the BC ENV regarding the Contaminated Sites Regulation (CSR) Stage 13 amendments (revised protocols and guidance documentation).  These documents came into effect on February 1, 2021.

Prairies: CBN submission to the AEP on the draft Site Specific Risk Assessment guide. This guide is expected to come out this year.

Ontario: CBN submission to the MECP in regards to amendments to excess soil regulations. These comments were coordinated with ONEIA (Krista Barfoot) and OHBA/BILD (Mike Collins-Williams).  The amendments were adopted in advance of the coming into force of O. Reg. 406/19 Onsite and Excess Soil Management.

The CBN has also submitted comments to the City of Toronto on a confidential draft of amendments to its Policy for Conveyance of Potentially Contaminated Lands. It is anticipated that amendments to the Policy will be brought to council in Spring 2021.

TAC continues to monitor regulatory changes affecting brownfields in all Canadian jurisdictions.  CBN members wishing to get involved, or bring forward opportunities for engagement on regulatory matters, are most welcome to contact the co-chairs.
